I AGREE to comply with the rules, regulations, and event instructions of the Honolulu Marathon, Start to Park 10K, Kalakaua Merrie Mile, the Honolulu Marathon Expo, and any race related events (the “Events”).

I UNDERSTAND that participating in a road race is a potentially hazardous activity and can result in serious injury or death.  I am aware of and I expressly assume all inherent risks associated with participating in the Events, including, but not limited to, falls, contact with other participants, and objects, the effects of weather, including high heat and humidity, traffic, and the conditions of the road.

I FURTHER UNDERSTAND that the novel coronavirus or COVID-19, has been declared a worldwide pandemic by the World Health Organization, is extremely contagious, and is believed to spread mainly from person-to-person contact.  As a result, federal, state, and local governments and their health agencies recommend social distancing and I understand that my participation in any of the Events could increase my risk of contracting COVID-19.  I understand that the Event sponsors identified below cannot guarantee that I will not become infected with COVID-19 while participating in any of the Events.  By signing below, I acknowledge the contagious nature of COVID-19, the lack of social distancing measures in the Events, and voluntarily assume the risk that I may be exposed to or infected by COVID-19 while participating in the Events and that such exposure or infection may result in personal injury, illness, permanent disability, and death.

IN CONSIDERATION of your accepting this entry, I for myself and anyone entitled to act on my behalf, waive and release from any and all claims for injuries and damages I may have against the Honolulu Marathon Association, the City and County of Honolulu, State of Hawaii, the United States of America, the Sponsors, USA Track and Field, their agents and representatives arising out of my participation in the Events, including pre and post-race activities.

I ATTEST that I am physically fit and have sufficiently trained for competition of the Events.  I am responsible for my own safety and wellbeing at all times at the Events.

I CONSENT to receive medical treatment which may be advisable in the event of illness or injuries suffered by me during the Events, and I agree to pay for the costs of my medical treatment.

I AGREE to receive mailings from the Honolulu Marathon Association which does not obligate me to purchase any marathon related product. 

I UNDERSTAND that if I have opted in during registration to receive information from a charity, or if I have made a charitable donation during the registration process, my contact details (including name and email address) may be shared with Realbuzz Group, the charity fundraising partner of the Honolulu Marathon Association, for the sole purpose of enabling Realbuzz or the selected charity to contact me with information relating to charity fundraising, participation opportunities, or my charitable donation.
I consent to such contact and understand that I may opt out of these communications directly with Realbuzz or the charity at any time.

I UNDERSTAND that all entries are final, with no refunds or transfers, and that the Event organizers reserve the right in the event of an emergency or local or national disaster to cancel the race or to change the day and/or time of any Event and that there is no refund of entry fees.  If the race event is cancelled due to COVID-19 safety protocols and/or government orders, no refunds will be provided but entry fees may be deferred and applied to the same live event the following year or to any virtual event held this year or the following year.

I GIVE PERMISSION for the free use of my name, voice or picture in any broadcast, telecast, advertising promotion or other account of the Events.

I acknowledge that the Honolulu Marathon Association event I am participating in has a relationship with a third-party vendor (the “Photographer”) who may take photographs of event participants, including me. I understand that the Photographer may collect, store, use, and/or transmit my biometric information (such as, for example, scans of my face geometry) for the purpose of identity verification to use, access, and purchase items related to my participation in the event. I understand and agree that the Photographer may retain my biometric information until the initial purpose for collecting or obtaining such information has been satisfied, or within three years of my last interaction with the Photographer, whichever occurs first. I understand that the Photographer’s Biometric Information Privacy Policy may be viewed at https://www.marathonfoto.com/Home/Privacy (the Photographer’s “Policy”). By electronically signing this document, I consent to the Photographer’s collection, storage, and use of my biometric information as set forth in the Photographer’s Policy. I also understand that the race organizer and any affiliated entities do not themselves capture, use, store, or access any biometrics which may be collected or captured by the Photographer.

I AGREE that electronic submission of this application constitutes agreement to all the terms of this waiver and release statement.

I WARRANT that I have read this Waiver, understand its terms, acknowledge that I will be giving up substantial legal rights by signing it, and intend for my signature to be my unconditional acceptance of the terms of this Waiver.
